In these Terms, “StudioMomentAI”, “Website” or “Seller” means the entity listed above.
3. What StudioMomentAI offers
StudioMomentAI allows customers to order personalized digital products, including MP4 videos, video invitations, digital graphics and creative assets prepared on the basis of a customer brief.
Products are delivered digitally. We do not ship physical media or postal parcels unless a specific product clearly states otherwise.
4. Definitions
Customer — a person or entity placing an order through the Website.
Consumer — an individual purchasing for purposes not mainly related to their trade, business, craft or profession.
Digital Product — a video, video invitation, graphic file, MP4 file or other digital asset prepared or delivered by StudioMomentAI.
Brief — the form or message containing the information needed to prepare the product, such as name, age, message, deadline, language, pronunciation notes, photos, files and other materials.
5. Orders
The Customer chooses a product or project type, continues to the brief, completes the required details and uploads any materials needed for production.
Before payment, the Customer receives an order summary, including the scope, selected delivery speed, price and delivery format.
The contract is concluded after the Seller confirms the order and the Customer pays for it, unless a specific order flow states otherwise.
The Seller may ask the Customer to clarify the brief if the information is incomplete, inconsistent or insufficient to complete the order.
6. Prices and payments
Prices are shown next to products or in the order summary. The final price may depend on video length, language, delivery speed, additional materials or the scope of personalization.
Payments are handled by a third-party payment provider, in particular Stripe, unless the Website indicates another method.
The Customer sees the final amount before payment. StudioMomentAI does not store full card details.
If the Customer needs an invoice, invoice details should be provided when placing the order or immediately after purchase.
7. Delivery
Digital Products are delivered as a file, download link or another digital access method.
Standard delivery is within 48 hours from confirmation of a complete brief and payment. Faster options may be available: within 24 hours, within 12 hours and within 6 hours.
The delivery time starts when the Seller has all details and materials needed to complete the order and the payment has been confirmed.
Urgent orders may be handled outside the standard queue. Shorter delivery times may increase the order price.
If the Seller does not meet the guaranteed delivery window, the Customer may receive a refund after manual verification. If the Customer still wants to receive the finished video despite the delay, the Seller may refund the difference between the very urgent delivery price and the standard delivery price.
8. Customer materials
The Customer is responsible for the accuracy and legality of the data and materials provided in the brief.
By submitting a child’s photo, pronunciation recording, name, image, message or other materials, the Customer confirms that they are entitled to use them for the order. If the materials relate to a child, the Customer should be the parent, legal guardian or have the appropriate consent.
The Customer must not submit unlawful, offensive or privacy-infringing materials, or materials that infringe copyright, trademarks, personal rights or third-party rights.
The Seller may refuse to process an order if the brief or materials breach the law, these Terms, third-party rights or safety rules.
9. Personalization, corrections and approval
Products are personalized based on the brief. The Customer should check the spelling of names, age, date, time, invitation text, pronunciation and other details before submitting the order.
If an error in the final file is caused by StudioMomentAI, the Seller will correct it at no additional cost.
If an error results from incorrect data provided by the Customer or from a later change of concept, corrections may require an additional fee or a new production.
10. Intellectual property, licence and use
After payment, the Customer receives the right to use the delivered Digital Product for a private celebration, invitation, family message, private publication or another purpose agreed in the brief.
If a project is ordered for a business, campaign, e-commerce or commercial publication, the licence scope should be agreed in the brief or in separate arrangements.
StudioMomentAI may reuse its own creative elements, templates, styles, production processes and technical solutions in different projects.
The Seller does not publish children’s photos or videos without explicit permission from the Customer.
11. Brand and inspiration notice
StudioMomentAI products may be inspired by popular themes, styles, cartoons, films, games, pop culture aesthetics or general visual categories.
The Website and its products are not affiliated with, endorsed by or sponsored by any official brand, studio or rights holder unless a specific product clearly states otherwise.
Personalized designs are custom, fan-inspired creative works for personal celebration use. The Customer must not use delivered materials in a way that suggests official affiliation, licensing, sponsorship or endorsement by a brand owner.
12. Right of withdrawal
Consumers generally have the right to withdraw from a distance contract within 14 days, unless a statutory exception applies.
For digital content supplied without a tangible medium, the right of withdrawal may be lost if the Customer has given prior express consent to begin delivery before the end of the 14-day withdrawal period, acknowledged that they may lose the right of withdrawal and received confirmation of the contract.
For personalized services or products prepared according to the Customer’s individual specifications, withdrawal rights may be limited to the extent allowed by applicable law.
If production has not started yet, the Customer may contact the Seller and request cancellation. The Seller will confirm whether cancellation and refund are possible at that stage.

13. Complaints
The Customer may submit a complaint if the Digital Product is not in conformity with the contract, does not match the description, does not work, has a significant technical error or has not been delivered as confirmed.
Complaints may be sent to: office@studiomomentai.com
A complaint should include:
- Customer’s full name
- e-mail address used for the order
- order number, if available
- description of the problem
- requested solution
- files or screenshots, if helpful
The Seller will respond no later than within 14 days of receiving the complaint, unless a different period is required by law.
If the complaint is justified, the Seller may in particular correct the file, deliver a new version, reduce the price or refund the payment to the extent resulting from applicable law and the nature of the issue.
For UK consumers, digital content should be of satisfactory quality, fit for purpose and as described.
14. Technical requirements
To use the Website and Digital Products, the Customer needs:
- internet access
- an up-to-date web browser
- an active e-mail address
- a device capable of playing MP4 files or displaying graphic files
- the ability to download or open a file link
The Customer should make sure that their device and apps support the delivered file format.
15. Personal data and privacy
Personal data processing rules are described in the Privacy Policy.
Cookie usage rules are described in the Cookie Policy.
16. Out-of-court dispute resolution
Consumers may seek help from local consumer advice bodies, consumer protection authorities or relevant alternative dispute resolution bodies.
The Seller aims to resolve disputes amicably and encourages Customers to contact us by e-mail first.
We do not add a link to the former EU ODR platform because the EU ODR platform has been discontinued.
17. Final provisions
These Terms are available free of charge on StudioMomentAI.
The Seller may update these Terms for important reasons, including changes in law, technology, payment methods, scope of services or organization of the Website.
Contracts with consumers are governed by Polish law, without limiting any mandatory consumer rights that apply in the consumer’s country of habitual residence.
